Liability for car accidents in Queens

Every year, many people are killed or seriously injured in wrong-way driving accidents. According to the AAA Foundation for Traffic Safety, “Findings show that between 2010 and 2018, there were 2,921 fatal wrong-way driving accidents resulting in 3,885 fatalities – an average of 430 deaths per year. Over half of these fatalities were wrong-way drivers (52.8%), a small percentage were their passengers (5.7%), while about four in 10 (41.1%) were occupants of other vehicles.” There are a number of common causes of car accidents.

  • Speeding
  • Distraction while driving
  • Poor road conditions
  • Driver fatigue

All drivers are required by law to exercise due care to avoid collisions with other drivers. To this end, drivers must drive their vehicles on the right side of the road with very few exceptions. There is a rebuttable presumption of negligence on any driver who strikes another vehicle on the left side of the road. Several steps should be taken after any car accident.

  • Photos should be taken of the accident scene.
  • A search should be carried out for surveillance material.
  • Medical records relating to the accident should be collected.
  • An experienced personal injury attorney should be contacted.

Car accidents are often very preventable. They happen much more often in urban areas and at night. It is important that accident victims understand that they have rights. The family of a person killed in a car accident may be able to obtain some measure of justice through a civil lawsuit.
