Rules and regulations for the use of fireworks

Monday, June 24 marks the first day of fireworks sales for the 4th of July celebration in Texas!

Fireworks sales in the state of Texas run from Monday through July 4 at midnight.

There are certain areas where fireworks cannot be used and even in areas where they are legal, there are many rules to follow regarding their use.

The Houston Fire Department is reminding people that it is illegal to set off fireworks anywhere within the city limits of Houston.

A Texas House Bill allows the transportation of fireworks, however, there are restrictions, including where the fireworks are located inside the vehicle and whether or not they are open. Click here to view details of bill HB1813.

Even in areas where fireworks are legal, certain rules must be followed.

For example, it is illegal to explode or ignite fireworks within 600 feet of a church, a hospital other than a veterinary hospital, an asylum, a licensed day care center or from a public or private primary or secondary school or an establishment of higher education, unless the person receives written authorization from this organization.

Fines range from $500 to $2,000 for each individual fireworks display. Warnings are no longer used due to the severity of fireworks laws. If a minor is caught handling fireworks, the parent or guardian will receive the fine even if they were unaware of the minor’s possession and/or use.

It is also illegal to sell, explode or ignite fireworks within 100 feet of a place where flammable liquids or flammable compressed gases are stored and dispensed. It is also illegal to explode or ignite fireworks within 100 feet of a place where fireworks are stored or sold.

You must also not light or throw fireworks in or near a motor vehicle.
