Buffalo man allegedly raped drunk victim

BUFFALO, NY (WIVB) — A Buffalo man was arraigned Thursday on charges of raping a victim while she was intoxicated and unable to consent, the Erie County District Attorney’s Office said.

According to officials, Joseph M. Folvarcik, 47, drove the victim from a bar in Orchard Park to his residence in Buffalo while working as a freelance taxi driver. Folvarcik then had sexual intercourse with the victim without the victim’s consent, officials said.

The victim was physically helpless due to his intoxication and therefore unable to give consent, officials said. Folvarcik was not known to the victim.

Folvarcik was charged with first-degree rape and sexual abuse. He faces a maximum of 25 years in prison and was released on $75,000 bail. A restraining order was issued on behalf of the victim.

A date for Folvarcik’s retrial has not yet been set.
