Illegal migrant, out on bail and under surveillance, rapes and kills 12-year-old girl

Franklin Jose Pena Ramos, 26, a suspect in the murder of 12-year-old Jocelyn Nungaray in Houston last week, appeared in Harris County Criminal Court on Monday. During the court hearing, it was revealed that he was wearing an Immigration and Customs Enforcement (ICE) ankle bracelet at the time of the alleged murder.

The ankle bracelet was issued to him after he was arrested by border guards for illegally entering the country and subsequently released from custody. In a statement to FoxNews On Friday, ICE said he “illegally entered the United States on an unspecified date and location without inspection, parole, or entry by a U.S. immigration officer.”

ICE also has an advance on Ramos, the agency said.

Judge Josh Hill, who presided over Monday’s hearing, also noted that Ramos and 21-year-old Johan Jose Rangel Martinez, the other suspect in the case, are accused of trying to raise money to flee the city.

During the hearing, the judge set Ramos’ bail at $10 million, above the $5 million requested by prosecutors.

Pena’s defense had proposed bail of $1 million, but the judge argued that there was an “astronomical” risk of him fleeing and said the likelihood of him returning to court was “virtually nonexistent.”

If Ramos posts bail, the judge ordered him to wear a GPS surveillance camera, be under 24-hour house arrest, stay in Harris County, have no contact with the other suspects or the victim’s family, avoid contact with minors, not possess firearms, drugs or alcohol, and surrender his passport.

Ramos and Martinez are said to have lured the young girl under a bridge in Houston, where they held her captive and inflicted fatal injuries.

“In this case, the defendant lured a 12-year-old girl under a bridge, where he and his co-defendant stayed with her for over two hours, removed her pants, bound and killed her, and then dumped her body in the bayou,” wrote Michael Abner, assistant district attorney for Harris County.

Police said investigators used surveillance footage to monitor the activities of the two individuals before and after the murder.

Both suspects are charged with capital crimes. Martinez is scheduled to appear in court for the first time on Tuesday.
