Todd Wildermuth, spokesman for the Roswell Police Department (RPD), said Pena was at the Adult Parole and Release Office in the zero block of Grand Avenue on the charge contained in an arrest warrant issued on April 24.

A criminal complaint filed against Pena alleges that he had sexual contact with an underage female relative on multiple occasions between December 2015 and June 2021. The sexual contact began when the alleged victim was 11 years old and ended when she was 16 years old.

Police learned of the allegations in August 2023 after an adult relative discovered messages on the alleged victim’s phone in which Pena allegedly talked about wanting to have sex with her.

The victim later told police that the incidents began when she and Pena were alone in an apartment. She stated that he pushed himself into her during the first episode.

According to the indictment, the incidents then escalated and included touching, removing clothes and finally sexual acts.

In the criminal complaint, the victim told police that Pena “had sexual contact with her so many times that she lost count” and that she “could not give an exact number.”

Some of the text messages Pena allegedly sent to the victim asked him for sex. In other messages, the indictment says, he asked the victim to meet behind her house and notified her when he was near or outside the house or when he was staying at a hotel.

The victim did not respond to any of Pena’s text messages.

According to the criminal complaint, the RPD attempted to locate Pena to speak with him about the alleged victim’s allegations, but was unable to do so.
