Man, 38, jailed for raping his 15-year-old lover

The offense under Section 376(2)(d) of the Penal Code carries a prison sentence of between 10 and 30 years and, upon conviction, flogging.

Kota Kinabalu: A 38-year-old man has been sentenced to 11 years in prison and given two strokes of the cane for raping his underage girlfriend seven years ago. Sessions Court Judge Amir Shah Amir Hassan handed down the sentence to Chrisdey Ceddy Ranti Bungal, who pleaded guilty to the charge against him.

Chrisdey was arrested on May 15 after failing to appear in court on May 27, 2017. He raped the 15-year-old girl between midday and midnight on January 15, 2017 in a room of a house in Tuaran. The offense under Section 376(2)(d) of the Penal Code carries a prison sentence of between 10 and 30 years and, upon conviction, flogging. The court ordered Chrisdey to serve the prison sentence from the date of his arrest on May 15.

After serving his prison sentence, he was ordered to be under police supervision for one year. As part of the mitigation, Chrisdey requested a lighter sentence and waiver of flogging because he suffered from many illnesses.

He added that he would like to be released if possible. However, Deputy Public Prosecutor Nurul Shafeerah Mad Iskim urged the court to impose a deterrent sentence as such a case was widespread. According to Nurul, a deterrent punishment could curb the frequency of similar cases in which young girls were victims of sexual violence. The court heard the incident occurred when the victim was leaving a residential home and her boyfriend Chrisdey then took her to his home. When he arrived at Chrisdey’s home, he raped the girl. The incident came to light when the girl’s teacher asked her where she was on January 15, 2017, as she was not in the hostel. The girl then narrated the rape incident.
