WARSAW – A Leesburg man must spend a year on probation for sexually touching a person without their consent.

Paul Jay Comer Jr., 33, 6908 E. May Lane, Leesburg, was charged with sexual assault, a Level 6 felony.

Comer was sentenced on Thursday, June 20, in Kosciusko Superior Court One.

Kosciusko Superior Court Judge Karin McGrath sentenced Comer to one year and four months in the Kosciusko County Jail, four months of which were served and one year of probation.

Comer will be given 70 days in prison.

A restraining order between Comer and the victim remains in effect. Comer must also register as a sex offender.

At the sentencing, Assistant District Attorney Jennifer Naue said the victim agreed to the proposed plea agreement and asked the court to sentence Comer accordingly.

McGrath told Comer that his confession was positive and pointed to a previous conviction for sexual abuse of a minor.

On July 13, 2023, Kosciusko County Sheriff’s Office officials spoke with a person who stated they had been raped by Comer.

According to court documents, the person said they had consensual sex with Comer on July 12, 2023. However, Comer attempted to have sex with the person a second time without their consent. The person said Comer forced himself on her despite the person asking Comer to stop approximately 20 times.

Comer told officers the person said “no” as if to say, “You’re not attracted to me,” not as if to say, “No, leave me alone.” He also said he is a registered sex offender.
