Report: New York migrant accused of raping woman in Brooklyn placed in ICE detention

The Nicaraguan migrant accused of raping a woman near a popular Brooklyn beach promenade this week was ordered detained by ICE after he was previously arrested on sexual assault charges, but was released after a plea deal with local prosecutors, a report said.

Daniel Davon-Bonilla, 24, had been at large since June when he was arrested late Sunday night for the alleged attack in Coney Island, according to the New York Post. The Big Apple is a “sanctuary city,” meaning local law enforcement generally does not cooperate with ICE warrants, which are requests to notify the agency before the immigrant is released from custody and to keep them in custody until ICE can take them into custody.

“The law does not allow us to coordinate with ICE. That’s the law. And you know, I’m not happy about it,” New York City Mayor Eric Adams told reporters on Tuesday when asked about Davon-Bonilla’s arrest. “You know, and I think he’s the prime example of what’s wrong by not doing that coordination. It’s clear that he doesn’t deserve to be in our city.”

“That’s the challenge we face,” Adams added. “The overwhelming number of migrants and asylum seekers who are here are trying to do the next thing and take a step on their next journey. But there is this small number that is problematic.”

Sources told the New York Post that an ICE warrant was issued for Davon-Bonilla after he was arrested in April 2023 for sexually assaulting a woman in a hotel converted into a migrant shelter in another part of Brooklyn.

According to WABC, Davon-Bonilla later pleaded guilty to second-degree assault and served a sentence at New York’s notorious Rikers Island prison complex before being released on June 24.

“After spending over a year in prison and at the victim’s request not to testify in any court proceedings, the defendant was offered the opportunity to avenge time already served by participating in the court-controlled broadcast,” WABC quoted prosecutors as saying.

The Brooklyn District Attorney’s Office told the New York Post: “Our prosecutors are generally unaware of the immigration status of defendants, and we do not contact immigration authorities (ICE) following admissions.”

New York City Councilman Bob Holden, a Democrat who represents part of the borough of Queens, told the newspaper that Davon-Bonilla’s alleged rape this week was “a direct result of City Hall’s refusal to step in and work with ICE to keep our communities safe. This leaves us at the mercy of those who should have been deported.”

“Instead of being arrested, convicted and punished by ICE, this lunatic was released back onto the streets only to commit the same heinous sexual assault again,” Holden added.

Davon-Bonilla, who New York Police Department says now faces charges including first-degree rape and sexual abuse in connection with the alleged attack Sunday night in Coney Island, is reportedly being held without bail after pleading not guilty.
