A 72-year-old convicted sex offender serving a 45-year prison sentence will soon be a free man, more than three decades earlier than planned.

On Thursday, August 8, Riverside County Superior Court Judge Scott P. Williams approved the release of Frank Duane Brown under the State of California’s Compassionate Release Law.

The law, also known as AB 960 or reversal of conviction, applies to inmates who, among other things, no longer pose a threat to public safety or are terminally ill.

Although Brown pleaded guilty to six counts of forcing lewd and lascivious sexual acts on a child under 14 in 2013 and was sentenced to 45 years in prison, California’s compassionate release law applies because of his metastatic liver cancer, CBS News reported.

Judge Williams granted the request for humanitarian release and ordered Brown’s release from prison within the next 30 days, according to a news release from the Riverside County District Attorney’s Office on Friday, August 9.

“Although early release is becoming more common, it is appalling that this release is even being considered when the offender committed a violent crime against a child,” said Riverside County District Attorney Mike Hestrin.

“Once again, the state is putting the victim in a traumatic situation and forcing them to fight to keep the perpetrator in prison until the court has passed judgment. This forces the victims to relive their devastating experiences. How can this be justice?” he continued.

The district attorney added that his office “remains firmly opposed to the early release of offenders in order to protect victims and ensure public safety.”

Hestrin called it “outrageous” that “an obviously dangerous sex offender” would be released before serving his full sentence.

In a video attached to the press release, the victim, who wished to remain anonymous, told his story.

“I lived with this man and he raped me almost every day,” the woman, identified only as “Jane Doe,” said in the video, among other things.

“After all the pain and trauma I went through, I finally thought, ‘Oh, it’s over, like they said, he’s going to jail.’ All that pain inside of me – I worked really, really, really hard to get myself back into a better place mentally and emotionally, and it scarred me forever,” she continued.

Brown served 11 of his 45-year prison sentence.

According to KESQ, the victim’s relationship to the accused is not immediately known.
