Man sentenced to 20 years in prison for sexual assault in Niagara Falls

BUFFALO, NY (WIVB) — A man of no fixed address was sentenced to 20 years in prison in Niagara County Court Friday for sexually assaulting a woman while threatening her with a knife, the Niagara County District Attorney’s Office announced.

Duvan Berrio-Hernandez had previously admitted to sexually assaulting a woman in Niagara Falls on November 5, 2023.


“What happened to this young woman was quite simply the realization of her worst nightmare,” Niagara County District Attorney Brian D. Seaman said in a press release.

“The defendant saw her walking, started to follow her and then exposed himself obscenely to her. She tried to flag down help, screaming for help, but she was unsuccessful. The defendant then chased her, threw her to the ground and sexually assaulted her while threatening her with a knife. This person was in this country illegally.”

Berrio-Hernandez was convicted of first-degree sexual abuse and will serve his sentence in state prison.
